While PUP Leader is looking to keep the Party united heading into a national convention, it is also preparing to take the Attorney General to court over the appointment of Appeals Court Judge Franz Parke.


The Party is preparing to file a leave for judicial review before the Supreme Court, requesting that the Court reviews the appointment and declares it improper, unconstitutional and therefore null and void.


PUP Leader John Briceno had indicated to the Prime Minister that he opposes Parke’s appointment because of insufficient experience in his resume. PM Barrow, who remembers Parke as a former law classmate, has proceeded with the appointment.


On September 29th, Briceno announced to the media that he would take the matter to the Court.

“Today we passed a resolution that we are going to challenge the Prime Ministers’ stands, we think it is unconstitutional, we believe that Franz Parke does not have the necessary qualification, no other than the Caribbean Court of Justice made a ruling that whenever you are going to name somebody to the Court of Appeals needs to be somebody of high legal standing and we don’t believe that Mr. Parke has that, he left the Caribbean since the 1980, yes we know he is buddy with the Prime Minister but that in anyway means that he qualifies to be a member of the court of appeals, the Prime Minister points out that he had already served in the Court of Appeals but we need to put on record that the time when Honourable Francis Fonseca was the Leader of the PUP and he wrote a letter not supporting it and during his short tenure he only sat on one case and if you are to look at the records you can see how much work he did on that case.”


The Court will consider the application and indicate whether there is sufficient grounds for judicial review.
