The prosecution case for the murder of Canadian national 38 year old Gabriel Buchnia, which occurred on October 4th last year, continues in its preliminary stages. On Monday, the suspect, 52 year old Apolonio Kiow returned to court as the prosecution prepares to present its case for the murder trial to proceed.
Kiow has been on remand at the Hattieville Correctional Facility since October 10th last year when he was arraigned before Magistrate Patricia Arana, following the laying of charges by the prosecution.
In Court, the prosecution announced that they are preparing to submit the final pieces of disclosure to Kiow, therefore, the matter was adjourned to March 28th.
The trial must first undergo a preliminary hearing in which the Magistrate will decide if the prosecution has a prima facie case for the murder charge against the accused.
Kiow was returned to the Hattieville Correctional Facility where he remains on remand.
Police believe that Kiow is the man who pulled the trigger on Buchnia outside his Chula Vista home. Buchnia was fatally shot to the abdomen in front of his family.
